Quick question for ya as I'm not quite sure how I feel about this and I value your professional opinions...

Ok... So, You have a design. You put it up for sale and someone expresses interest. They ask you to integrate their brand name in some way ( not a logo, just the brand name worked in to the design itself ) and ultimately purchase the design. Months and months go by and one day you get an email out of the blue from said client requesting the PRE-brand-name-integrated PSD file so they can sub the design to Threadless in hopes of winning some sort of profit back since they never did anything with it.

How would &lt;b&gt;&lt;i&gt;you&lt;/b&gt;&lt;/i&gt; feel about this?</body>

      <body>You say good one mate but no deal. You put on a comp and if you win you give him half of what he paid. If that&#180;s a no go hold onto it and use it on something other than a tee. You don&#180;t owe him anything so he should be greatful for the favour.</body>

Because the .PSD file sent was POST-brand-name-integration. There's really no way to edit it out short of erasing most of it an redoing a majority of the linework.</body>

      <body>its not his artwork, its yours. You sold him a limited license to reproduce the artwork on a tee shirt. Even if there's no agreement, the art is legally yours under current copyright law. Feel free to politely tell him where to shove it. </body>

      <body>Yeah, I dont know that he knows how strange a request it is. He didn't come at me all rude-like or demanding so I don't think we'd have any sort of problem over it.

Dereks got it right.  He would actually be violating Threadless' Terms of Agreement by subbing it. Even threadless only buys a limited shirt production license from you, you still own the art and can produce alternative pieces (not Tees) with it.  Long story short, Big NO GO!  </body>
